1. About World Trust Index and these Terms
(a) Welcome to World Trust Index (WTX), a professional certification service operated by World Ethics Organisation Pty Ltd (we, us, our).
(b) The WTX website (www.worldtrustindex.com) and related services (the Service) are provided to you subject to these Website Terms of Use (Terms).
(c) By accessing, using or applying to WTX, you confirm that you have read, understood and agree to these Terms. If you do not agree, you must not use the Service.
(d) These Terms apply to website visitors and applicants. If you become a paying Member of WTX, you will also be bound by the WTX Certification Terms.
(e) We may update these Terms from time to time. Material changes will be notified by email to active Members and published on this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
2. Who WTX is for
(a) WTX is a professional certification service that independently verifies the ethics and integrity of working professionals through peer assessment.
(b) Applicants must:
- Be at least 18 years of age
- Be working in a professional capacity
- Be able to nominate a minimum of 10 Assessors who meet the WTX Assessor criteria
- Comply with these Terms
(c) WTX is not a regulatory body, professional licence, or substitute for any required professional qualification, registration or licensing required in your profession or jurisdiction. WTX Certification is a recognition of professional ethics and integrity, awarded based on independent peer assessments.
(d) You agree that the information you provide is accurate, complete and current, and that you will update it as necessary.
3. The WTX Certification process
(a) WTX Certification is issued by WTX based on assessments completed by independent, verified Assessors, scored against the WTX Global Code of Ethics and Integrity.
(b) The high-level process is:
- Complete the WTX Eligibility Assessment
- Submit your application
- Pay the Subscription Fee to secure your place
- Nominate at least 10 Assessors and complete your 10 confirmed assessments
- WTX reviews the assessments. If you meet the standard, Certification is awarded.
(c) Detailed terms governing Certification, including refund and renewal policies, are set out in the WTX Certification Terms.
4. Subscription Fee, payment and refunds
(a) Subscription details, payment processing and refund terms are set out in the WTX Certification Terms.
(b) All payments are processed by Stripe. By making payment, you agree to Stripe's terms of service.
5. Your obligations as a website visitor
When you use the Service, you agree to:
(a) Provide accurate, current and complete information (b) Use the Service only for lawful purposes (c) Not scrape, copy, reproduce or misuse content from the Service (d) Not use the Service in connection with any competing service without our express written permission (e) Not attempt to manipulate, interfere with or disrupt the Service (f) Keep your account login details (if any) confidential
6. Intellectual property
(a) All content on the WTX website, including the WTX name, Trustmark, Global Code of Ethics and Integrity, assessment framework, branding, visual identity, reports, and website content, is the property of World Ethics Organisation Pty Ltd or its licensors.
(b) Except for the limited rights granted in the WTX Certification Terms (where applicable), no other intellectual property rights are granted. You must not copy, reproduce, modify, distribute, publish, sell or exploit any WTX content without our express written permission.
(c) You retain ownership of any content you provide to WTX. By providing that content, you grant WTX a worldwide, non-exclusive, royalty-free licence to use it solely for the purposes of delivering the Service.
7. Disclaimers and limitation of liability
(a) The Service is provided on an "as is" and "as available" basis. While we take reasonable care to ensure the Service is reliable, we do not guarantee it will be uninterrupted, error-free or completely secure.
(b) Nothing in these Terms excludes, restricts or modifies any non-excludable consumer right or guarantee under the Australian Consumer Law or any other applicable consumer protection legislation.
(c) Subject to clause 7(b), and to the maximum extent permitted by law:
- We exclude all terms, guarantees, warranties and conditions not expressly stated in these Terms
- We are not liable for indirect, consequential, special or punitive loss, including loss of profit, loss of opportunity, loss of goodwill or reputational loss arising in connection with the Service
- Our total aggregate liability in connection with the Service is limited to the amount of any fee paid by you in the 12 months immediately preceding the event giving rise to the claim. If no fee has been paid, our total aggregate liability is limited to AUD $100.
(d) WTX Certification is a professional recognition based on independent peer assessments. It is not a guarantee of any professional's future conduct. WTX is not liable for any loss arising from decisions made by any party in reliance on a WTX Certification.
8. Indemnity
You agree to indemnify WTX, its officers, employees, contractors and agents against any claim, loss, damage or liability (including reasonable legal costs) arising from:
(a) Your breach of these Terms (b) Your violation of any law or third-party right (c) Any content you provide to WTX that is inaccurate, unlawful, or infringes a third-party right
9. Privacy
Your personal information is handled in accordance with the WTX Privacy Policy, available at www.worldtrustindex.com/privacy.
10. Dispute resolution
(a) If a dispute arises in connection with these Terms or the Service, you agree to follow this process before starting any legal proceedings (except for urgent interlocutory relief):
- Notify our concierge team in writing at concierge@worldtrustindex.com, setting out the nature of the dispute, the outcome you seek, and the action required to resolve it.
- We will respond within 14 days and attempt to resolve the dispute in good faith.
- If the dispute is not resolved within 30 days of the initial notice, the parties will attempt mediation through a mutually agreed mediator, or a mediator appointed by the Resolution Institute. The parties will share mediator fees equally.
- If mediation does not resolve the dispute within a further 60 days, either party may commence legal proceedings.
(b) All communications in connection with dispute resolution are confidential and made on a without-prejudice basis.
11. Governing law and jurisdiction
(a) These Terms are governed by the laws of Western Australia, Australia.
(b) The exclusive jurisdiction for any legal proceedings is the courts of Western Australia, Australia, except where non-excludable consumer laws of your country of residence require otherwise.
12. General
(a) Entire agreement. These Terms, together with the Privacy Policy and (where applicable) the Certification Terms, form the complete agreement between you and WTX.
(b) Severance. If any provision is found unenforceable, that provision will be severed and the remainder will continue in force.
(c) No waiver. Our failure to enforce any provision is not a waiver of that provision.
(d) Assignment. You may not assign your rights under these Terms without our written consent. WTX may assign its rights in connection with a sale, merger, or restructuring.
(e) Force majeure. WTX is not liable for delays or failures arising from events outside our reasonable control.
(f) Notices. Notices to WTX should be sent to concierge@worldtrustindex.com.
